September 16th Meeting with DOL in Albany NY

Invitation to a Special PACNY Meeting:
September 16, 2026 PACNY Special NYSDOL Presentation & Industry Meeting: 
Come hear it directly from NYSDOLPACNY invites you to participate in a special meeting featuring representatives from the New York State Department of Labor Asbestos Control Bureau.
Speaking to our group will be Jason Pensabene, Program Manager, along with a representative from the Engineering Services Unit.
NYSDOL will discuss its recent directive addressing the disposal of ACM-contaminated concrete debris generated during controlled demolition involving friable ACM, including the requirement to obtain USEPA approval before requesting a NYSDOL Site-Specific Variance (SSV).
This meeting will provide an opportunity to hear directly from NYSDOL regarding:

• The reasoning behind the new directive
• When and how the USEPA approval requirement applies
• What contractors, consultants, project designers, and building owners should understand before planning controlled demolition work
• The process for requesting an SSV involving disposal of ACM-contaminated concrete debris
• How the directive may affect project planning, scheduling, waste handling, and disposal
• Questions and concerns from industry professionals regarding implementation of the directive

Rather than relying on secondhand interpretations, this is an opportunity for the regulated community to hear directly from NYSDOL about what is expected, why the directive was issued, and how it will be applied in the field.
The meeting will also provide an opportunity for meaningful dialogue between NYSDOL and industry professionals regarding current interpretations, enforcement practices, and issues affecting asbestos projects throughout New York State.
PACNY membership is not required to attend. Contractors, consultants, project designers, building owners, environmental professionals, and others involved in asbestos and demolition work are encouraged to participate.
